The Particular Sales Conditions mentioned below (hereinafter referred to as the "Particular Sales Conditions") govern the offer and sale to the consumer by IGLUCO TECH S.L., and through this website www.glucube.com (hereinafter referred to as the "Website"), of the product GLUCUBE (hereinafter referred to as the "Product").
The completion of the purchase that you, as a Client of IGLUCO TECH S.L., make, expressly consents and authorizes, freely and voluntarily, your submission to our Legal Notice, our Privacy Policy, as well as to these Specific Sales Conditions, which will be available for your storage and printing once you formalize your Order.
1. Definitions
According to the current Specific Conditions of Sale of the website www.glucube.com, and along with other definitions included, the following terms have the meaning indicated below.
"General conditions": are all the sales conditions of the website of www.glucube.com, applicable to the contractual relationship existing between IGLUCO TECH S.L. and the Client.
1.2 "Seller": The provider of the Products offered for sale through the Website and, in particular, IGLUCO TECH S.L., located at Avda. de la República Argentina 25, floor 8, 41011 Sevilla (Spain), registered in the Mercantile Registry of Sevilla: Sheet SE-109901 Volume 6211 Folio 111, NIF: B90270034.

"Product": GLUCUBE glucose measurement system as well as all its complements and accessories, which are duly described in www.glucube.com.
1.4 "Customer or User": is the buyer of the Product, and as such, it refers to the individual who makes the purchase for personal use.
"Web Page": the set of pages that can be accessed on the network through the URL located at www.glucube.com
"Contract": The sales contract for the Product, entered into between the Seller and the User, by accessing the Terms of Sale and following the stipulated procedure and instructions for this purpose in those sections.
2. Purpose of the online contract
The purchase by the Customer of the Product whose characteristics are described in www.glucube.com, and its subsequent delivery by the Seller following the provisions of the section "Delivery Time and Method of Product Delivery" in these Terms of Sale.
3. Communication consent
IGLUCO TECH, S.L. will process your personal data when you provide it during the purchase in accordance with our Privacy Policy, which is available on our website.
The purchase of the product/service by the customer authorizes IGLUCO TECH to communicate with the customer via email, phone, WhatsApp, or any instant messaging that facilitates communication between both parties.
4. Prices
The selling prices of the Product indicated on the Website are expressed in euros.
3.2 The prices of the Products and services offered on the Website will be those listed at the time you place your Order(s) and will be total, detailing shipping costs (if any), the Value Added Tax (VAT), as well as any other tax, fee, or levy of a regional nature that may apply. Due to their special tax regime, for orders placed from the territories of the Canary Islands, Ceuta, and Melilla, local indirect taxes equivalent to VAT will apply.
3.3 The prices applied are those indicated on the Website at the time of the customer's purchase request. The Seller reserves the right to modify its prices at any time, so you should verify them prior to placing your Order.
3.4 The prices of each of the Products listed on the Website cancel and replace the previous ones.
3.5 Payment for the Product may be made using the payment methods described in section 10 of these Specific Sales Conditions.
5. Order formalization and sales procedure
The purchase of the Product will be formalized upon the selection and acquisition of the Product(s) on the Website. Before you finalize your Order, IGLUCO TECH S.L. will ask you to validate it, in order to avoid any unintentional errors, reminding you of the non-free nature of your acquisition. To this end, you must validate the shipping and billing address.
The Contract will come into effect when the purchase order made by the User is expressly confirmed by the Seller. To this end, once the User's purchase order is received, the Seller will send an email to the electronic address provided by the User, confirming the receipt of the Order. This email will contain a summary of the essential characteristics of the Product, contact details of the Seller, as well as a copy of these Specific Sales Conditions, and will specify the price, shipping costs (if any), as well as any other expenses, payment method, and delivery conditions of the Product, and how to exercise, if applicable, their right of withdrawal, for which we will provide the appropriate form.
The User must verify the content of the communications and inform the Seller of any errors or omissions that they may detect in it as soon as possible.
If the User does not receive the confirmation email from the Seller within 24 hours from the date the purchase order transmission procedure was completed, they should contact the Seller in the manner provided in the Contact section of the Website.
If it is not possible to fulfill the User's orders partially or totally, the Seller will promptly send an email to the User informing them of this circumstance and possible solutions, without prejudice to the User's right to withdraw from the contract and to obtain a refund of the corresponding amount already paid.
If there are any delivery restrictions on the Product, the Seller will inform you of this at the beginning of the purchase process, so that you can decide whether to continue with it or not.

6. Delivery time and method of product delivery
IGLUCO TECH S.L., after receiving the payment and verifying the availability of the Product in stock, will send it to the address designated by the User via courier. The delivery will be carried out by the Seller using courier services and/or trusted messengers, or personally through their managers or employees.
IGLUCO TECH S.L. does not guarantee the accuracy in determining the availability of the requested merchandise, as access and the ability to place an order online modify the availability of the Product in real time. Consequently, the estimated shipping times are, in fact, mere estimates. When we process your Order, we will inform you as soon as possible in the event of a lack/break in stock for any of the Products you have requested.

5.4 The Seller agrees to package the purchased Product appropriately according to its characteristics. The Seller is not responsible for the integrity and proper preservation of the Product at the time of delivery by the carrier. In the event that the Product has been damaged as a result of transportation, the User must refuse delivery if the damage is visible without the need to open the package, without prejudice to the User's right to withdraw from the contract in accordance with the provisions of current regulations.
5.5 The delivery of the Products is subject to the payment by the Customer of the corresponding price through the method chosen from the options available on the Website www.glucube.com puts at your disposal.
5.6 IGLUCO TECH S.L. issues the tax documentation (invoice in digital format) based on the data corresponding to the user's coding carried out at the time of registration on the Website.
7. Product characteristics and availability
If an order exceeds the quantity of stock in the warehouse, IGLUCO TECH S.L. will accept the purchase and will inform the Buyer via an email message about the availability of the Product and the expected delivery time. IGLUCO TECH S.L. is committed to respecting the deadlines communicated regarding delivery times, even though they are not binding.
8. Responsibilities of IGLUCO TECH S.L.
IGLUCO TECH S.L. is not responsible for the proper functioning of the Website or for delays in the delivery of orders due to force majeure of any kind. Examples of force majeure include, but are not limited to, measures taken by public authorities, strikes by its own workers, strikes by third-party workers, and transporters on whom IGLUCO TECH S.L. depends, as well as other circumstances that are beyond its control or independent of it.
9. Customer obligations
The Customer agrees, once the online purchase procedure is completed, to keep these Particular Conditions of Sale.
8.2 The Customer must read and accept the information contained in the Specific Sales Conditions before submitting the purchase request. Acceptance is done by checking the corresponding box on the Website. If it is not checked, the order cannot be placed.
Minors are not authorized to purchase Products at www.glucube.com.
10. Right of withdrawal - Return policy
Right of withdrawal/Return:
You have the right to withdraw from the Contract after completing the order formalization process, without any penalty and without providing any reason, within 14 (fourteen) business days from the date of delivery of the Product.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the Contract through an unequivocal statement via email addressed to EMAIL, or our contact form in the help area at https://www.glucube.com/contact
The notification must contain an unequivocal statement of your intention to exercise the right of withdrawal from the Contract and the following information:
- User Identification Data.
- Purchase order or invoice number and date.
- In the case of partial withdrawal, the number of products intended to be returned.
- User's bank account (IBAN) where the amounts refunded by the Seller must be deposited.
The User must return the Products intended for return in the original packaging.
10.2. Consequences of withdrawal:
In the event of your withdrawal, we will refund all payments received from you, including delivery charges (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method we offer) without any undue delay and, in any case, no later than 14 calendar days from the date we are informed of your decision to withdraw from this Contract.
We will proceed to issue the refund using the same payment method you used for the initial transaction, unless you have expressly stated otherwise; in any case, you will not incur any costs as a result of the refund.

We will promptly notify you by email of the receipt of such withdrawal.
Likewise, you must return or deliver the purchased Products to us without any undue delay and, in any case, no later than 14 calendar days from the date you communicate your decision to withdraw from the Contract. The deadline will be considered met if you return the goods before that period has expired.
11. Payment method
Payments made by credit card or other electronic means will be processed through a secure connection, directly linked to the banking provider that holds and manages the online payment service with which IGLUCO TECH S.L. is associated.
The User may make the payment for the price of the requested Product according to the available payment methods, to be chosen at the time of placing the order.
If the User requests the sending of an invoice, it will be sent after payment, in electronic format, to the email address provided by the User. For the issuance of the invoice, the User guarantees the accuracy of the information provided at the time of placing the order.
12. Problems viewing the pages
The Client must have the appropriate equipment and software for connecting to the Internet. In the event that the Client is unable to view part or all of the Website, IGLUCO TECH S.L. shall not be held liable for any charges or responsibilities.
13. Service Suspension
IGLUCO TECH S.L. reserves the right to suspend the display of the Website in all or some of its functions in relation to all needs concerning its effectiveness and security. In such cases, IGLUCO TECH S.L., unless there are special urgent reasons, will communicate this to its Clients as soon as possible, by the means it deems most appropriate.
14. Shipping and Returns
If, at the time of delivery by the carrier, any non-conformities are noted or if the merchandise is visibly damaged, the Customer must indicate this on the carrier's delivery note and inform IGLUCO TECH S.L. This communication should be directed to the after-sales service department of IGLUCO TECH S.L. In any case, the Customer must always verify that the merchandise has been delivered in perfect condition and it is recommended to indicate on the carrier's delivery note “CONFORME SALVO EXAMEN” (ACCEPTED SUBJECT TO INSPECTION), so that they can later claim any non-conformity and the corresponding return. Otherwise, the carrier will consider the receipt of the Product as accepted.
Next, we will show you what to do in the event that the Product arrives damaged, is defective, or is incorrect:
Damaged product during shipping: If you receive a damaged product during shipping, you can return it within 10 days from the date of receipt of the order. Please contact our Customer Service for detailed information.
Incorrect product: you can return the Product to us within 10 days from the date of receipt of the Order. Please contact our Customer Service for detailed information.
Defective product: you can return a defective product to us within 10 days from the date of receipt of the order. Please contact our Customer Service for detailed information.
Non-conforming product: any possible claim/return due to a defect in conformity of the Product must be submitted along with proof of purchase of the Product to IGLUCO TECH S.L. (invoice issued by IGLUCO TECH S.L. and provided at the time of purchase to the Customer).
The presentation of a conformity defect must be communicated by the Customer by contacting Customer Service through the channels provided for this purpose.
IGLUCO TECH S.L. will inform the Customer of how to return the non-compliant Product.
IGLUCO TECH S.L. will carry out the relevant qualitative controls to verify the actual non-conformity of the Product and will provide this analysis to the Client through the authorized means for this purpose.
In the event of confirmed non-conformity of the Product, IGLUCO TECH S.L. will proceed to reimburse the Customer for the shipping costs incurred in returning the non-conforming Product and, at no cost to the Customer, will proceed with its repair or replacement with a new Product; in the latter case, the non-conforming Product will remain the property of IGLUCO TECH S.L.
The refund will be processed by IGLUCO TECH S.L. using the same payment method used by the Customer for the initial purchase.
15. Guarantee
The Seller guarantees the authenticity of the Product offered for sale through this Website, and that such Product is manufactured and packaged in accordance with the applicable regulations.
In no case does the warranty cover the use of the Product that does not comply with the instructions in the user manual provided by IGLUCO TECH S.L.
16. Modifications to these conditions
IGLUCO TECH S.L. reserves the right to modify the rules governing these Specific Sales Conditions as well as the economic conditions applied therein. IGLUCO TECH S.L. will duly inform you of any future modifications that may be introduced in these Specific Sales Conditions. If you do not agree with any of the updates that may be introduced in the future, you may express your disagreement at any time by contacting the email address provided above.
17. Discrepancies and applicable laws
Any discrepancies related to the application, execution, interpretation, and breach of the online Contract stipulated between the Client and IGLUCO TECH S.L. shall be subject to Spanish jurisdiction.
For everything that is not explicitly stated, the applicable legislation regarding the relationships and conditions set forth in the online contract between the Client and IGLUCO TECH S.L. prevails.
14.3 Both parties shall submit any disputes arising from the Contract, with an express waiver of any other applicable jurisdiction, to the exclusive jurisdiction and competence of the courts and tribunals of the city of Seville (Spain)
